ISBE Special Education Complaint Procedure
Summary of Complaint Filing Process*:
- Go to ISBE and the superintendent
- Be from the parent/guardian or accompanied by a letter of consent from the parent/guardian (or student if over 18)
- Allege a violation of a special education law, rule, or regulation contained in IDEA, Article 14 of the Illinois School Code or Title 23 of the Illinois Administrative Code
- Alleged violation must have occurred not more than one year prior to the date the complaint is received by ISBE
- Contain a proposed resolution
- List school district personnel who have been contacted about the issue(s)
- Be signed
Complaint will not be investigated if
- Not in writing
- Anonymous
- Occurred more than one calendar year prior to the receipt of the formal complaint
- Complaints seeking advice regarding parental rights but not requesting the initiation of formal action
- Not related to special education law or regulations
- When Complaints – Investigation
- ISBE Special Education Support and Services Division will investigate, identifying findings of noncompliance, and verifying completion of any corrective action requirements.
- Full investigation within 60 calendar days, including a written decision detailing process, findings, and corrective actions
- Corrective action must be taken within the specified timeline, but no later than one year from the date of the findings
- v Filing a complaint does not preclude requesting a due process hearing.
